Personal Release and Terms of Service

For good and valuable consideration, the receipt of which is hereby acknowledged, I grant to Kovacs Institute or its authorized representative, assigns or licensee(s) (collectively KI), the unrestricted right and license to record, film, photograph, tape and otherwise capture and reproduce in any manner, my name, stage name, voice, likeness and performance. Furthermore, KI shall have the right and license to use any biographical material that I might furnish to it, or which KI might obtain from others. All images and sound captured on tape or otherwise shall be referred to in this document  as the “Recordings." I further agree that KI  shall  own all rights in the Recordings, (ii) have the right to use the Recordings, in whole or in part, in any manner or media (whether now existing or created in the future, and (iii) be entitled to use the Recordings as KI deems appropriate, including, without limitation, for promotion and publicity purposes, in perpetuity, and in all languages, throughout the universe. "Media" for purposes of this Personal Release shall include, but not be limited to, television broadcasts and rebroadcasts, newspapers, magazines, books (both paper and electronic), Internet and other electronic distribution, videotapes, CDs, DVDs, and electronic databases.

KI is under no obligation to use or exhibit the Recordings in any manner. I waive (i) the right to inspect or approve of any use of the Recordings, (ii) any rights to injunctive relief I may have in connection with this release, (iii) the right to revoke this Release at any time in the future, and (iv) any moral rights I may have in the Recordings.  I further release and agree to hold harmless and indemnify KI from any and all claims, demands, causes of action, damages, liabilities of any kind, and reasonable attorney’s fees which may arise out of, or in connection with, the use by KI of the Recordings.

 I agree that no sum shall be due to me for execution of this release and KI shall not be obligated to pay me or any third party any sum whatsoever, regardless of the time, frequency or method of any future use of the Recordings. I have been informed that KI  and its owners, officers and employees will not be responsible for any damages, accidents or injuries that may happen to the user, its agents, servants, employees, or property of any of the participants or persons who are participating in this request, including but not limited to those causes which results from the negligence of the user, its agents, servants, employees or that of the facility and said user hereby releases KI, its employees and agents from and agrees to indemnify it against any and all claims for any such cause which results in injury.  I understand that I will undergo physical assessments and training during services provided by KI and it is my responsibility to inspect the facilities and equipment used. If I believe anything to be unsafe, I will immediately advise KI of such unsafe condition(s) and may decline the services. KI are not medical doctors and thus consult with your own doctor for any medical advice.
I release and discharge KI and each of its affiliated organizations, directors, officers, sponsors, employees, agents, successors and assigns from all claims for any liability, injury, loss or damage in any way connected with my use of the KI Facility and/or services, whether or not caused in whole or part by the negligence of any of the organizations or individuals mentioned above.  I intend for this waiver and release to also apply to my relatives, personal representatives, heirs, beneficiaries, next of kin and assigns whom might pursue any legal action or claim for such liability, injury, loss or damage.

This document shall be governed by the laws of the State of Georgia, regardless of the place of its physical execution and shall be binding on my legal representatives, heirs, and assigns.  I represent and warrant that I have the right, power, and authority to grant the rights set forth in this document; furthermore, if a minor is depicted in the Recordings, I represent and warrant that I am either a parent or legal guardian of the minor child and that I have complete authority to grant this Release on the minor child's behalf. This Release represents the entire understanding in effect between the parties.

The course materials and information are copyright material; the copyright is owned by the KI unless stated otherwise. Without limiting the foregoing, copying the above listed materials to any other server or location for publication, reproduction or distribution is expressly prohibited.
